We will not be liable for any damages, losses, expenses, indirect losses or consequential damages of any kind, suffered or incurred by you in connection with your access or use of this website.
If the New Zealand Consumer Guarantees Act 1993 applies, you may have rights or remedies which are excluded or limited by the above. If you are using this site or its content for business purpose, the above exclusions and limits will apply and the New Zealand consumers Guarantees act will not apply. We will take action to correct errors or inaccuracies brought to our attention within a reasonable amount of time.
Prices
The prices for the products on the website are stated and are payable in New Zealand Dollars (NZD)
All prices and delivery charges within New Zealand are inclusive of New Zealand Goods and Services Tax at the rate of 15%.
We may vary any prices on our website at any time and without notice to the buyer.
Availability
All orders are subject to the availability of the products. If for any reason a product is not available, we will endeavour to notify the non-availability on our website. We may revise the range of products or the specification of any product at any time and without notice to the buyer.
Cancelation of orders
We reserve the right to cancel the buyers order if the products are listed at an incorrect price or with the incorrect information on our website. Where the buyer has already made payment for an order that is subsequently cancelled we will refund the amount paid by the buyer in relation to that order.
We cannot cancel any order that has already been made up. If the cancellation is made prior to the flowers being made up, we will accept cancellation and provide a full refund.
Return Policy
We stand by our products 100%, if for any reason something has gone wrong please do contact us directly on 09 308 9494 or by email eden@botanist.co.nz.
Please note we cannot accept the flowers back if you change your mind as they are a perishable product.
Return conditions
Requests to return goods must be submitted within 3 days from the date of shipping and the original 3 days from the date of shipping and the original.
Where goods are accepted (for credit or refund at our discretion) they must be delivered at the buyer's expense into the seller's store in original condition and packaging. Returned products are the buyer's responsibility until they reach the seller. The seller shall not be responsible for misdirected shipments or products lost or damaged in transit.
The seller reserves the right to levy a restocking fee against any returns the seller may agree to accept. Such fees may be up to 15% of the invoice priced and levied at the seller's absolute discretion.
Any refunds (at our discretion) will be refunded in the form of the original payment method used by the buyer.
Delivery / Shipping Policy
Once we confirmed acceptance of the buyer’s order, we will endeavour to dispatch the buyers order within the specified time frame.
For Auckland locations that are not rural deliveries can be same day as long as the order is in before 10am on the day of delivery.
All other Auckland deliveries are next day. We discourage deliveries outside of Auckland.
We will try its best to deliver any product within the time frames indicated however we do not guarantee delivery of any product if the recipient refuses to accept the gift, the address provided is not correct or complete, the recipient is not at the address specified or it is unsafe to enter the address.
If the recipient is not at the address specified when the delivery is made, we will do its best to leave the product in a safe location. If we do leave the delivery in what we believe to be a safe location, we will not be liable if it goes missing or is lost or damaged.
In the unlikely event that a product cannot be delivered it will be brought back to our studio or to our agents premises and we will make contact with you to arrange a new delivery time and date. The customer will remain responsible for the cost of all deliveries. A second delivery attempt may incur an additional charge.
Goods leaving are adequately packed for delivery.
No damage claims will be considered after 2 days of receipt of goods. While no liability of goods damaged or lost in transit will be accepted by The Botanist Floral Stylist Limited, details of any claim should be advised to The Botanist Floral Stylist Limited.
